White Paper – Whistleblowing in Germany

Thanks to the EU Whistleblowing Directive for the first time in German history whistleblowers will be protected against reprisals. Although the directive has not yet been transformed into a national law (which should have happened until December 17, 2021) the effects on German corporate culture can already be felt. A few details still need to be sorted out by the new government, but already there is no time to be lost.

In some (court) proceedings the directive might even have an immediate effect, in any case some time will be needed to establish the appropriate procedures (such as an internal system), especially if a works council has co-determination rights.
